Article 1: Scope of Application
1.1 Scope of Application
These General Terms and Conditions of Sale (hereinafter "GTC") apply to any order placed remotely by a natural person with legal capacity and acting in a personal capacity as a consumer with SPICY CANDY, either directly on the SPICY CANDY website accessible at the following address: www.spicycandy.fr.
1.2 Exclusions
These GTC may be modified at any time by SPICY CANDY. It is your responsibility to consult and formally accept them before placing any order.
The applicable GTC are those appearing on the Site at the time of your order.
Any order placed on the Site implies full, unreserved and unconditional acceptance of the GTC in force at the time of said order.
Article 2: PRICE INFORMATION
2.1 Reference prices indicated on the sites
The reference price of the Products offered on the site is the recommended price by the brand, the manufacturer or its official representative. Failing this, it is a price determined according to the prices at which the Product is commonly sold in a panel of retailers distributing it. This price is updated as soon as the brand, the manufacturer or its official representative communicates a new recommended price for the Product or as soon as the price practiced within the panel of retailers is modified.
2.2 Modification of prices indicated on the sites
The prices of the Products are indicated on the product description pages. They are indicated excluding tax, customs duties and shipping costs. The Company reserves the right to modify the prices of the Products at any time, in compliance with applicable legislation.
The ordered Products will be invoiced on the basis of the price in force on the site at the time of the Order validation.
2.3 Product prices
The prices of the Product(s) do not include packaging, conditioning, shipping, transport, insurance and delivery costs of the Product(s) to the delivery address.
Article 3: ORDERS
3.1 Availability of products and services
Our product and service offers are valid within the limits of available stock. The availability of products and services is indicated on each product sheet.
If, despite all our efforts, a product or service becomes unavailable after your order has been validated, SPICY CANDY will inform you by email and refund the price of the product or service initially ordered as well as any amount paid for your order. However, if your order contains other available products or services, these will be delivered to you and the delivery costs will not be refunded.
3.2. Order Placement Procedures
It is possible to place an order with SPICY CANDY:
- Online at www.spicycandy.fr;
No order sent to SPICY CANDY by any other means, including by mail or SMS, can be taken into account.
When placing your order, you must confirm it by the "double-click" technique: after having selected and added products and/or services to your cart, you must:

check your cart and possibly correct its content (e.g., identification and quantity of selected products, corresponding prices, delivery methods and costs);

validate your cart;

accept the GTC and your obligation to pay for the order.
3.3 Order Registration
Once your order has been placed in accordance with Article 3.2, SPICY CANDY will acknowledge receipt by sending you an order confirmation email including:
- a summary of your order,
- its number
This email will be sent to the email address you use to log in to your Customer Account. If you do not receive the email mentioned above, we recommend that you contact our Customer Service.
SPICY CANDY reserves the right not to validate your order for any legitimate reason, particularly in the event that:
- your order does not comply with the GTC;
- the quantities of products ordered do not correspond to the normal use of a private individual;
- one of your previous orders has not been fully paid on time;
- a dispute concerning the payment of one of your previous orders is being processed;
- several serious and converging elements suggest a suspicion of fraud on your order.
Article 4: PAYMENT METHODS
The payment methods listed below may be offered by SPICY CANDY:
(1) Bank cards: only bank cards linked to a banking institution located in France are accepted.
(2) Via Paypal
You can pay for your order via PayPal, up to a limit of 500 euros. To use this payment method, you must have an account with PayPal. In case of payment via PayPal, PayPal's general terms and conditions of use apply.
(3) Gift card
It is possible to use gift cards issued by SPICY CANDY to pay for all or part of your order. These gift cards can only be used once. In the event that a customer fraudulently attempts to use one of these gift cards multiple times, the orders concerned by this fraud will be automatically cancelled by SPICY CANDY.
General provisions
SPICY CANDY reserves the right not to offer one or more of the above payment methods, for any legitimate reason, particularly in the event that:
- the payment partner no longer offers the service in question;
- one of your previous orders has not been fully paid on time or a dispute concerning the payment of one of your previous orders is being processed;
- several serious and converging elements suggest a suspicion of fraud on your order.
Article 5: PAYMENT SECURITY AND FRAUD PREVENTION
Online payments on the Site to SPICY CANDY are made via a secure payment platform, supplemented by specific control measures for each payment method, to guarantee the security of purchases made on the Site and to combat fraud. The bank details communicated when placing your order are encrypted using the Secure Socket Layer (SSL) protocol.
SPICY CANDY has partnered with STRIPE to protect you when you place an order on www.spicycandy.fr. To this end, STRIPE collects, via a cookie, a device identifier (also called "Device fingerprinting") to control your orders as part of the fight against fraud. This identifier is generated from technical information relating to the equipment you use when placing an order on the Site.
You are informed of the collection of this information as soon as you first connect to the Site via the cookie information banner. By continuing your navigation on our site or by clicking on the cross on the information banner, you accept the collection of the device identifier.
You can withdraw your consent to the collection of this identifier at any time by clicking on the "Manage my cookies" tab on the "Privacy and cookies" information page and by deactivating "Analytics and Personalization" cookies.
Article 6: SHIPPING AND DELIVERY
SPICY CANDY may offer you, when placing your order, different delivery methods depending on the size of your package and your delivery address. SPICY CANDY does not deliver to: military bases, armies and barracks.
Delivery conditions, costs and times differ depending on the delivery method you choose.
You will be informed, when placing your order, of the available delivery method(s) as well as the applicable deadlines and prices.
6.1 Delivery methods and costs
SPICY CANDY can offer you different delivery methods.
The delivery of certain products or in certain areas may incur additional charges. In such cases, this information is clearly indicated on the delivery information page, accessible at the bottom of each page of the site.
The total amount of your order's delivery costs is indicated when placing the order.
DELIVERY TO THE ADDRESS OF YOUR CHOICE
For the delivery of your small items to the address of your choice, SPICY CANDY can offer you one or more of the following delivery methods:
- Standard delivery: Delivery of ordered products is made to the delivery address indicated when you placed your order.
- International delivery: Delivery of ordered products is made to the delivery address indicated when you placed your order for countries other than metropolitan France.
- Premium Delivery: Delivery of ordered products is made on a priority basis, including insurance against theft, damage or loss of your order. (Recommended Delivery)
6.2 Delivery
6.2.1 Delivery Date
The delivery date of the products varies according to demand. Generally, delivery times range from 3 to 4 days.

6.2.2 Territories served SPICY CANDY delivers orders to Metropolitan France, including Corsica, with the exception of specific exclusions.
As well as internationally with additional costs.
6.2.3 Late Delivery
In case of late delivery, SPICY CANDY will endeavor to inform you.
You can also notify us of late delivery by contacting our Customer Service.
SPICY CANDY undertakes to do what is necessary to determine the cause of the delay and find an appropriate solution for the effective delivery of the ordered products as soon as possible.
If the 90-day period without receiving your order is exceeded, you are entitled to request a refund for your order, including delivery costs.

6.2.5 Incorrect address
If the address provided by you (customer) is incorrect, and the package is returned to our workshops. The customer is responsible for paying the costs of a new shipment.
To optimize the processing of your requests, please indicate in all your correspondence, regardless of the channel used: your first name, last name, email address with which you placed your order, and the number of the order concerned.
Article 7: RECEIPT
7.1 Missing Accessory and/or Part
Upon receipt or collection of your order, you must check that your product conforms to your order.
7.2 Damaged Products Delivered
Upon receipt of your order, you must check the condition of the received package(s) and report any non-conformity on the delivery note or refuse delivery.
In the event that, after accepting the package, you find that the ordered product is damaged, you can report it to us:
- by contacting SPICY CANDY Customer Service;
and this, no later than within three (3) calendar days after receipt of your order.
Article 8: WITHDRAWAL
8.1 Principle and Period
The Customer has the right to withdraw, without giving any reason, within fourteen (14) calendar days from the date of receipt of their Order. In the case of an Order of several Products, the period runs from the receipt of the last Product.
If the right of withdrawal is exercised within the aforementioned period, the price of the purchased Product(s) and shipping costs will be reimbursed, with return shipping costs remaining the responsibility of the Customer.
8.2 Exclusions
In accordance with the provisions of Articles L. 221-18 to L. 221-28 of the Consumer Code, this right of withdrawal cannot be exercised for the following contracts:
For the supply of goods or services whose price depends on fluctuations in the financial market beyond the professional's control and likely to occur during the withdrawal period;
For the supply of goods manufactured according to the consumer's specifications or clearly personalized;
For the supply of goods liable to deteriorate or expire rapidly;
For the supply of goods unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
For the supply of goods which, after having been delivered and by their nature, are inseparably mixed with other items;
For the supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on market fluctuations beyond the professional's control;
For maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by them, within the limit of spare parts and work strictly necessary to respond to the emergency;
Supply of audio or video recordings or computer software when unsealed by the consumer after delivery;
Supply of a newspaper, periodical or magazine, except for subscription contracts for these publications;
Concluded at a public auction;
8.3 Terms for exercising the right of withdrawal
To exercise their right of withdrawal, the Customer must inform the Company of their intention to withdraw either by filling out the standard form, a model of which is provided below, or by sending an unambiguous declaration expressing their intention to withdraw within the 14-day period mentioned above.

The Customer has a period of 14 days from the sending of the notification of their withdrawal to return the Product to the Company in its original packaging, with return costs being the sole responsibility of the Customer.
8.4 Acceptance Conditions
Products must be returned in their original and complete condition (packaging, accessories, instructions, etc.) to allow for resale by the Company. In case of receipt of opened, used, incomplete, damaged or soiled Products, the Company will not issue any refund and may even, if it deems it necessary and appropriate, hold the Customer responsible for the depreciation of the Product.
In case of return of the Product under the conditions provided by law and these GTC, the Company will refund all sums paid by the Customer, including delivery costs, within 14 days of the withdrawal notification, unless the Product is returned later. In this case, the Company will only issue a refund after receipt and verification of the returned Product's condition.
This refund will be made using the same payment method as that used by the Customer to pay for the Order, unless the Customer expressly agrees to another payment method. In case of payment by gift voucher/promotional code, the Customer will be refunded either by sending new gift vouchers/promotional codes for an amount identical to that paid in this form.
